The Government of the Federal Republic of Somalia has received financing from the World Bank toward the cost of Somali Sustainable Fisheries Development Badmaal Project (SSFDP) and intends to apply part of the proceed for consulting services.
The Consulting Services (the Services) include review the fisheries laws of Puntland, Galmudug, Jubbaland, Hirshabelle, and Southwest states to ascertain ensure their compatibility with the Law of Fisheries Management and Development No. 008 of 2023 of the FGS; propose amendments to the fisheries laws of the aforementioned FMS to ensure their alignment and compatibility with the FGS’ Law of Fisheries Management and Development No. 008 of 2023; and, harmonize the existing fisheries laws of Puntland, Galmudug, Jubbaland, Hirshabelle, and Southwest State, with a view to ensuring consistency in fisheries governance across these FMS, validating and completing, where appropriate, the findings from the Legal Analysis Report provided by Initiative Development Vision (IDV) which identified gaps, inconsistencies, and areas for improvement in the current laws. Additionally, the project aims to facilitate consultations with a diverse range of stakeholders, including government officials, fisheries experts, coastal communities, fishers’ and fishmongers’ organizations/associations, where they exist, legal practitioners and relevant civil society organizations (CSOs) and non-governmental organizations (NGOs), to gather insights and ensure that the fisheries laws reflect the perspectives and needs of all relevant parties. The Consultant will undertake all the specific tasks detailed out in the Terms of Reference (TOR).
The consultancy service is expected to be conducted and reports delivered within 6 Months from the date of commencement. The Ministry of Fisheries and Blue Economy (MFBE) now invites eligible consulting firms (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services (brochures, description of similar assignments, experience in similar conditions, availability of appropriate skills among staff, etc.). The short-listing criteria are as follows:
Core business of the firm shall have a minimum of Seven (7) years of experience in conducting legal analysis, advisory services or drafting legal documents.
The firm should have experience in conducting stakeholder consultations and engaging with government officials, civil society organizations, community members, underrepresented people, and other relevant stakeholders. The Consultant shall provide the name and contact address of the Client (office and e-mail address and telephone number), date(s) of execution, name (s) of lead and associate firms, contract amount and financing sources.
Experience of relevant services in an environment similar to that of Somalia; and
The technical and managerial organization of the firm. (Provide only the structure of the organization). Do not provide CVs of staff). Key experts will not be evaluated at the shortlisting stage.
The attention of interested Consultants is drawn to paragraphs 3.14, 3.16 and 3.17 of the World Bank’s Procurement Regulations for IPF Borrowers: Procurement in Investment Financing - Goods, Works, Non-Consulting and Consulting Services dated July 2016 and revised in November 2017 August 2018 and November 2020 and September 2023, (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest.
Consultants may associate with other firms to enhance their qualification but should indicate clearly whether the association is in the form of a joint venture and/or a sub consultancy. In case of a joint venture, all the partners in the joint venture shall be jointly and severally liable for the entire contract, if selected.
A Consultant will be selected in accordance with the Consultant Qualification Based Selection (CQS) method set out in the World Bank’s Procurement Regulations.
